Death Penalty Essay Example | Topics and Well Written Essays - 2000 words - 1

Capital punishment - Essay Example Our central matters for the cancelation of capital punishment are profound quality and detail. The first contentions for the death penalty doesn't any longer apply yet are obsolete †discouragement, requital, and so forth. The lessons of custom essays the Bible †the Old and the New Testaments †disclose to us one significant part of creation: secure life and don't permit retribution. God didn't execute Cain for murdering his own sibling Abel yet rather sent him on outcast and put an imprint on him with the goal that nobody would slaughter him. An entry in the Bible of states: ‘an tit for tat, a tooth for a tooth’. This instructing doesn't mean ending the life of a killer or somebody who has carried out a deplorable wrongdoing, yet it implies restricting the retaliation for an offense. At the point when Jesus was introduced the lady blamed for infidelity, he didn't censure the lady however told those present â€Å"to cast the first stone†, which implies we ought not denounce anybody yet permit a miscreant to change. Another contention is the ground of detail. The criminal equity framework, a human framework, is imperfect. That is to say, it isn't generally impeccable in spite of all the brilliant, lawful personalities the world has ever delivered. Decisions are not great. The Supreme Court decided that capital punishment damaged the Eight and Fourteenth Amendments. At that point in another decision in 1976, Gregg v. Georgia, the Court again repudiated itself by deciding that capital punishment in essence was not unlawful. (Bedau 2005, p. 23) In Furman, it was decided that some state rules were unlawful, which permitted that capital punishment resolutions must be reworked. Supporters of capital punishment started proposing new laws for the death penalty. As it were, supporters of capital punishment deciphered this as a chance to compose new laws so that there would be no more questions of holding capital punishment. It was accounted for that there were 35 states that revised their

Antony and Cleopatra Research Paper Example

Antony and Cleopatra Research Paper Example Antony and Cleopatra Paper Antony and Cleopatra Paper indeed, even through all the pictures of disintegration and demolition, Enobarbus is set up to stay dependable, Ill yet follow the injured possibility of Antony. . He scornes the possibility that Caesar, with extraordinary militaries under his influence high-struggled Caesar, would forego his favorable luck unstate his joy by battling with a rehearsed fighter be organized to th appear/Against a sworder. Enobarbus considers what can be in staying faithful to a numb-skull Mine trustworthiness and I start to square However he at that point remarks that To follow with a falln Lord/Does overcome him that did his lord vanquish/And gains a spot Ith story. This impactful remark about winning a spot in the story and increasing an ethical triumph over Caesar is the main explanation he can consider to remain with Antony. Enobarbus before long offers the picture of rodents leaving a sinking transport, anyway the equivocalness of the picture is that he could be alluding to either himself or Cleopatra. Thou craftsmanship so broken, that we should leave thee to thy sinking, for thy dearest quit thee. The incongruity of Enobarbus choice to in the long run leave, isn't lost on us, he can see reality in everything except for himself. Which is the reason Enobarbus acquires his place in the story. After his renunciation, Enobarbus remarks are loaded with incredible feeling and make the aurora of conclusiveness. O sovereign fancy woman of genuine despairing, for Shakespeares crowds, Melancholy was not only misery, it was a profound and dark hopelessness that could blow the heart. It is that Enobarbus is petitioning God for, after his acknowledgment that he relinquished everything that he represented. During Act 4 scene 6 he is gone up against by the explanation which he remained by Antony in any case, it is this acknowledgment of a shocking misstep that he should pass on and he declares I will go look for/Some jettison in wherein to pass on. The accompanying talk contains yet more symbolism of making and disintegration This blows me extremely upset. , where Enobarbus uncovers his actual contemplations. Anyway it is the Elizabethan conviction that to be loaded with contemplations was to be brimming with despair , despondency and pain that worries Enobarbus he feels that any longer idea will execute him he additionally says that he is un-steadfast deceiver with a crown of gold, better my administration when my turpitude Thou dost so crown with gold! , which is the contrary view to what we consider him to be. His discussions of completing every foul idea, it is this dim symbolism of breaking and breaking that makes the mysterious end to his life, favoring the moon (which in Elizabethan occasions was thought to causes sadness, disease, and even franticness) and afterward shouting out to Antony as he passes on. His last demonstration is to approach Antony for absolution for abandoning him, Forgive me in thine own specific, But let the world position me in register An ace leaver and an outlaw. O Antony! O Antony! His practically hyperbolic response shows his last affirmation of his own reality that the Roman characteristics about him were more vulnerable than the Egyptian qualities. Enobarbus disaster is the deplorability of a skeptical psyche combined with a delicate heart. His skeptical and target sees (the observer and truth teller. ) regularly are subverted by his lovely, and kind side (Antonys confindantn and his discourse in Act 2 scene 2). His acknowledgment of himself a the end certainly earns himself a spot Ith story.

Aspects of Thai Buddhist Culture

Parts of Thai Buddhist Culture Section V Thai Culture At the start of this examination I had expected to have two areas in the last part, one segment itemizing the Buddhist underlying foundations of everything Thai and the other demonstrating Hindu/Indic impact. This thought has been surrendered by the creator because of the constrained exclusively Buddhist impact. There are numerous parts of Thai culture that have consolidated components of different nations, for example, China, Laos and so on however I have decided to restrain the correlations with Buddhist/Hindu at every possible opportunity. The examination will rather concentrate on itemizing the parts of impact and state whether they have a joined impact or whether they have been affected by just one of the subjects. The peruser will at this point welcome the monstrous extent of Hinduism and as such it will demonstrate hard to track down parts of Thai Buddhist culture that don't have probably some premise in Hinduism. The normal cause of the Indian sub-landmass and the artifact of Hinduism make such an emotional report troublesome. Thus I embraced a study of numerous Thai individuals, including yet not restricted to, my companions, my understudies, neighbors, priests, and so forth. I solicited them to make a rundown from 20 things that they viewed as Thai or that which they thought may be seen by remote guests as illustrative of their nation and culture. The appropriate responses were fluctuated (and, now and again interesting because of language) and from the appropriate responses they gave I have made a rundown out of the outcomes. (appeared on next page). The rundown has been organized one after another in order and I have restricted the rundown to the most widely recognized answers. The rundown may have been affected by local portrayal the same number of the individuals offered territorial responses, for example, Isan, or the rocket celebration. The appropriate responses were unprompted by the creator and I feel that the rundown is precise with the end goal of this investigation. Almsround by the Monks Expressions and Crafts Vessel Races/Royal Barge Procession Buddhism Elephants Buffaloes Isan/Isarn Landmarks Mai Pen Rai ! Contributions/Merit Making Downpour Dance Regard for Royalty Rocket Festival Sovereignty Sanctuaries/Shrines Thai Smile/Friendliness The Wai ( Thai Greeting ) Thai Boxing Thai Festivals Ceremonies Thai Dance/Thai Dress Thai Food/Fruit Sculpture Thai language Thai writing Thai Massage/Traditional Thai medication Thai music/instruments Thai Silk Tuk ( 3 wheel vehicle) Sanuk ! Sukhothai Kingdom The recognizing peruser will take note of that Hinduism is missing from the rundown. This was a touch of astonishing to the creator as I had circulated approx 200 reviews and had about 60% returned finished and not a solitary answer had Hinduism or Brahmanism as an answer. Buddhism was on each and every rundown came back to me and that was not at all astonishing. I had not thought to make my own rundown before asking the Thai individuals their feeling and I think this was a mix-up or rather an oversight on my part. I can't recollect precisely what I thought about as Thai-ness, yet the Thai grin and the Wai welcome would have been remembered for any rundown. Westerners who visit the Kingdom for the most part know ahead of time about the Kingdoms Buddhist sanctuaries and the cordiality of the individuals. The Thai language has all the earmarks of being hard for the normal outsider/westerner to ace and thus I have decided to start my examinations by taking a gander at the Thai Language/Thai Script. There was clearly a Thai language well before there was a composed Script. By a wide margin the most fascinating thing about the Thai content is that it was created by a Thai ruler ! Very few nations can make such a case, yet is there any premise to the case which is generally acknowledged by most of the Thai individuals? The sources I counseled all concurred that the Thai content has its foundations in India. Actually, a significant number of the South East Asian contents are fundamentally the same as they all have a similar root, in particular the Brahmi content of antiquated India. At the hour of the Sukhothai Kingdom the nation of Siam was heavily influenced by the Khmer Empire. All things considered, the Khmer letters in order had an effect on the Thai letters in order. A glance at the first vagga/varga of Khmer Thai consonants will show the striking similitudes. Khmer Palm Leaf Script Present day Khmer Present day Thai Different Scripts which Thai has obtained from are the Mon, Burmese, just as the Khun, Tham or Lanna contents which were existent before the main known Thai composition. Tham/Lanna Khun Burmese Burma Northern Thai Scripts Modern Thai Script The Tai Tham content, otherwise called the Lanna content is utilized for three living dialects: Northern Thai (that is, Kam Muang), Tai Lã ¼ and Khã ¼n. Likewise, the Lanna content is additionally utilized for Lao Tham (or old Lao) and other tongue variations in Buddhist palm leaves and scratch pad. The content is otherwise called Tham or Yuan content. The most seasoned Thai engraving dates from 1283. The Thai content is a syllabic letters in order dependent on the Brahmi content which was adjusted to compose the Siamese/Thai language. Its innovation is credited to King Ramkhamhaeng, who ruled over Sukhothai from 1275 to 1317. The Ramkhamhaeng Stele This stone, presently in the National Museum in Bangkok, was supposedly found in 1833 by King Mongkut, who was a priest at that point, in Wat Mahathat. It ought to be noticed that the legitimacy of the stone or if nothing else segments of it has been brought into question.[[1]] Piriya Krairiksh, a scholarly at the Thai Khadi Research establishment, takes note of that the steles treatment of vowels recommends that its makers had been affected by European letter set frameworks; subsequently, he infers that the stele was created by somebody during the rule of Rama IV or right away previously. The issue is disputable, since if the stone is in actuality a manufacture, the whole history of the period should be re-written.[[2]] Researchers are as yet separated over the issue about the steles authenticity.[[3]] It stays an abnormality among contemporary works, and in actuality no other source alludes to King Ramkhamhaeng by name. A few creators guarantee the engraving was a finished nineteenth century manufacture, others guarantee that the initial 17 lines are real, that the engraving was manufactured by King Lithai (a later Sukhothai ruler), and a few researchers despite everything accept especially in the engravings authenticity.[[4]] The engraving and its picture of a Sukhothai ideal world stays key to Thai patriotism, and the proposal that it might have been faked during the 1800s caused Michael Wright, a British researcher, to be compromised with expulsion under Thailands severe lese majeste laws .[[5]] Phra Lewis, a western priest who has lived in Thailand for as long as 8 years, put forth an admirable attempt to clarify the development of the Thai language and exhibited that while the communicated in language has advanced after some time, ie the sound of the consonants changing, their situation in the surd/sonant framework has not modified likewise. This was extremely useful to my exploration work in this investigation as I had experienced some trouble looking into Thai words because of the a wide range of spellings I experienced. There is in reality a Royally endorsed arrangement of interpretation, yet it isn't constantly followed and there are various casual frameworks in wide use. For instance, the Sanskrit word Dharma is the Pali word Dhamma yet the Thais call it Tam, another model is the Thai word Bangsakun which is really Pamsakula in Pali. Composed Thai is exceptionally organized and adheres to straightforward guidelines with no uncertainty concerning the elocution like there is in English. The Thai language is tonal and that is the place most issues emerge for the outsider. The old style of elocution was no uncertainty modified when the capital moved from Sukhothai in the north, to Ayuddhya in the focal district. The letter ? (K) became G, the ? (C) became J and the ? (J) became CH, etc. The vowels were additionally changed marginally. Except if consonants are in any case stamped they convey an innate vowel. In Indian dialects this is ordinarily an a yet in Thai the principles are somewhat unique. The inalienable vowel is an o however in the event that the word has more than one syllable, at that point the primary characteristic vowel is an and the second innate vowel is an o. The model underneath shows the word for street Thanon Before proceeding onward to inspect celebrations and functions I might want to take a gander at a striking element of the Thai language. For this data I am obliged to Phra Lewis who called attention to it as well as disclosed it to me as follows :- The over 44 consonants of the Thai letters in order have been appeared with their cutting edge phonetic sounds. A few letters change sound change contingent upon where they are in the syllable. They have been indicated on a level plane in vaggas dependant upon where the sound is made. The first vagga is throaty, made in the throat. The last line are not appeared in their vaggas. The primary vertical segment should show the surd, the second section the surd suction, the third segment shows the sonant and the forward shows the sonant suctioned. Segment five is the nasal sound made. In the first vagga of the chart we can see that the G and K hints of present day Thai have exchanged positions and in the event that one glances at the following vagga ie the palatal vagga, we can see the J has likewise moved. The priest has guessed this happened when the Thais moved their funding to Ayuddhya. The letters M, L, H in the diagram shows the class of consonant ie center , low and high. This ought not be mistaken for the tones of the language. Looking down the principal section we see all the letters are white collar class, the following segment are on the whole high class and the rest of the letters in the 5 vaggas are low class consonants. The consonants in the last, longer, line can likewise be set in their vagga, ie Y would have a place with the palatal vagga, H in the throaty and so forth. This class of consonant element is special to Thai however the lattice is the organization of most of Indian dialects. The ruler didn't develop the framework however he may well have been the instigator for the configuration of

What Debt Collectors Can and Cant Do

What Debt Collectors Can and Can’t Do What Debt Collectors Can and Can’t Do What Debt Collectors Can and Can’t DoIf you’re applying for a loanâ€"any loanâ€"it’s important that you figure out whether you can afford to make your payments. Because if you can’t, you’re going to end up dealing with a debt collector.Sometimes these collectors work for the lender that gave you the loan, but many times they are actually a second company. The lender sells the debt at a discount to a debt collection agency, who then starts contacting you to try and collect on the money that you owe. While there are many, many debt collectors that do everything above board, there are also companies that try to bend the rules in order to get people to pay. If you’re past due on a debt and dealing with a debt collector, it’s good to know what rights you have.“The main statute on debt collection is the Fair Debt Collection Practices Act (FDCPA),” says Braden Perry (@bradenmperry), a regulatory and government investigations attorney with Kennyhertz Perry, LLC.Perry says, â €œIt’s important to remember that FDCPA applies to only 3rd  party collection firms, and not first parties collecting on their own behalf. But many companies don’t know that even if you are collecting first party, you are subject generally to the same fundamentals of the FDCPA through the Consumer Financial Protection Bureau (CFPB) via unlawful, deceptive and abusive acts and practices.Keeping that in mind, here’s a quick guide to what debt collectors can and can’t do.They Can: Contact you by phone, mail, email and text message“According to the FDCPA, a debt collector can contact you by phone, or postal mail,” says business author Michelle Dunn (@DunnMich). “Some debt collectors also contact using cell phones, email or text, though the law does not cover that.”The reason that the law does not cover cell phones, email, and text, is because it was written in 1978. The ways that people communicate have changed a lot since then.   And if you prefer to communicate with a debt collector through email, it’s a good idea to use your personal email address. The reason for this is because your work email is usually not confidential. Your employer can search through your email at any time. Since your correspondence with a debt collector is supposed to be confidential, this can make your work email a no-go.They Can’t: Contact you any time or placeThe FDCPA clearly states that a debt collector cannot contact you before 8 A.M in the morning or after 9 p.m. at night.Of course, if you’re someone who works a non-traditional schedule, those late nights and early mornings might actually be the most convenient times for you. In cases like that, you can request that the debt collector contact you outside those standard hours. They simply require your permission in order to do so.Debt collectors also cannot call you at work if you have told them that you’re not allowed to discuss this issue while at your job. If you tell a debt collector that you cannot speak to them at work and they continue to contact you there, that’s a sign that you should be wary. They Can: Call people other than youAccording to Dunn, debt collectors are allowed to contact your spouse and speak to them about your debt. If you have an attorney who is representing you regarding the debt, the collector is also allowed to speak to them.Other than that, debt collectors cannot talk to anyone else about your debt. (Remember when we said that these communications were confidential?) However, they can speak to other people in order to obtain your contact information, phone number, address, etc.A debt collector can call your employer to verify that you work there and to find the best way to reach you. But if a debt collector calls your employer and tells them about the debt, they are breaking the law.1They Can’t: Threaten or harass youThis is a big one. And while it does not happen a lot, it’s one of the practices that have led to debt collectors having a not-so-great re putation.Plainly put, a debt collector cannot threaten or harass you in any way, shape, or form in order to get you to pay your debt. These practices include:Threatening to harm your reputationThreatening to make your debt publicThreatening violence or physical harmUsing obscene or profane languageCalling you repeatedly to annoy youThreatening to garnish your wages or seize your property without a court orderThreatening legal action if they do not intend to do soThreatening to add false information to your credit reportTelling you that you will be arrested if you don’t pay2As Dunn puts it, “threatening to put someone in jail is different than asking someone to pay in full or by a certain date.”They Can: Take you to courtAccording to Dunn, a debt collector can actually sue you and go to court to collect your debt at any time.“They can take you to court immediately,” she says, “but most try to collect the debt by traditional means before going to court.   No one wants to go to court, so hopefully the debtor pays before that action has to be taken.”This makes sense, as taking someone to court can be expensive and time-consuming. But if you are unresponsive to a debt collector or refuse to acknowledge that you owe them a debt, most of them will sue you in order to recoup what you owe.Do your best to settle your debt before it gets to that. If the collector sues you and wins their case, the court will issue a judgment authorizing a garnishment. This means that the debt collector can take part of your wages out of every paycheck until the debt is fully repaid. They Can’t: Lie and pretend they’re someone elseIf a debt collector calls you and pretends that they are someone else, that is illegal. Full stop. The reason collectors do this is because it can make debtors seem like they are in more trouble than they actually are. A call from the government saying that you owe money, for example, is going to freak you out a bit more than a call from a regular debt collector. Some debt collectors will claim that they are attorneys or representatives from a credit bureau. Others will send what appear to be official-looking documents that seem like they are from a court or government agency. No matter what, any debt collector who claims they are anything other than a debt collector is breaking the law.If you have a debt collector that is using illegal methods to try and collect on your debt, you should contact one or all of the following:The office for your state’s Attorney GeneralThe Consumer Financial Protection Bureau (CFPB)The Federal Trade Commission (FTC)Note: Some people think that taking out a payday loan wont hurt their credit. And while payday lenders dont report your information to the credit bureaus, debt collection agencies do. Failing to pay back your payday loan and having it sent to collections will end up hurting your credit even further. The easiest solution is also the best: Never take out a payday loan!To learn more abou t debt collection, check out this article from the FTC.About the Contributors:Michelle Dunn, has worked in the credit and debt collections industry for over 30 years.   She started and ran her own third party collection agency and eventually sold her business in order to write full time.   Michelle is the author of many books on the topic of credit, debt collection and starting a collection agency.   Michelle is now a consultant and presenter for the credit and collections industry.Braden Perry, is a regulatory and government investigations attorney with Kansas City-based Kennyhertz Perry, LLC. Closed universe memorandum - 1100 Words

Closed universe memorandum (Term Paper Sample) Content: Closed universe memorandumNameCourseProfessorDateClosed universe memorandumTort liability of municipality whether police, the fire department or emergency medical services is viable only when certain conditions are fulfilled. A petitioner has to prove that the defendant's failure to respond to the formers' call for help is the direct cause for their injury. The government entity is held liable for tort charges if it can be proved that there was presence of a duty by the county to the individual, if the county breached the duty, if the petitioner suffered injury and the breach of contract is the reason for the said injury. A county department can only be accused of negligence only if there was a duty to the plaintiff and the duty was breached. In order for petition of negligence against a government entity, the plaintiff must prove without reasonable doubt that there was a form of privity established between the plaintiff and the county official. The county officials s uch as the police and fire fighters are protected under the constitution and are immune to cases of negligence by the public duty doctrine unless privity is established with the plaintiff. They are obliged to provide duty to the public and not to an individual. This means that duty owed to the public is duty owed to no one. However, a special relationship exists if there is a form of privity between the plaintiff and the public office. In SINKS v. RUSSEL 34P.3d wash .APP. Div.2.2001, John Stocks and Gerald Stinks contacted 911 to report Cencich had threatened them. As a result the 911 operator told them to wait at the scene for a police officer. This qualifies as a special relationship between the plaintiff and police department. De novo for privity to stand there should be a telephone conversation followed by affirmative agreement to offer assistance. In BEAL FOR MARTINEZ v. CITY OF SEATTLE 954 P.2d(Wash, 1998), Ms Fernandez called the city of Seattle police department to report that Melissa's (her daughter) was in danger from her husband, Fernando, who was refusing her to take her belongings. As a result, the 911 operator confirmed that a police was dispatched to the route. Thus there was a telephone conversation and affirmative promise for protection. This was not the case in Mary A. Cummins v. Lewis County 156 wash.2d 844. Here Mary Cummins, who was a personal representative of the estate of Leon V. deceased petitioner, argued that privity could be established not necessarily with a telephone conversation but so long as a call was made to the 911 emergency. Leon V., the decedent, called 911 and spoke,'1018E street, heart attack.' According to Mary Cummins, the proposition of revealing the location and condition was evidence for privity. This was denied since actual conversation forms basis for privity. For a government entity to be held accountable for tort due to breach of duty there should be a form of assurance given to the plaintiff for the fulfillment of a duty; failure of which leads to injury to the plaintiff. In Babcock V. Mason County Fire Dist. No.6 30P.3d 1261(Wash. 2001), James C. Babcock, and Kiyocko Babcock (husband and wife) accuses Mason county fire department of negligence. The two identify that at the moment they got home their house was on fire but not the garage. The firefighters did nothing to salvage neither the garage nor their tent trailer 15 feet from the burning house. According to the plaintiff, the defendant was negligent for not preventing their property from damage. James C. Babcock, and Kiyocko Babcock claimed the defendant failed to honor their duty after providing assurance from an unidentified lady fire fighter  who confirmed they would take care of protecting our property . The court dismissed the petitioned on speculation that assurance from some unidentified fire fighter was not viable. In the case of Chambers Castanes v. King County 669 P.2d 451 (Wash 1983), Jim Chambers and Steve Ann Chambe rs Castanes moved a Petition against King County police department for negligence. After Jim Castanes was attacked by two men who emerged from a vehicle parked by the road, Ann Castanes called the police department and reported the case. The 911 operator assured her that help was on the way. Other witnesses reported the same and the operator still replied in the affirmative. There were a total of 11 phone calls to the police department and in the entire the operator assured that the police are on the way. This was valid assurance that showed that put the King County Police department liable for tort. A government entity cannot be in breach of duty if assurance to help that puts the entity under personal duty to the plaintiff cannot be established. In SINKS v. RUSSEL 34P.3d wash .APP. Div.2.2001, John Stocks and Gerald Stinks, were told by the 911 operator that an officer was being sent to the scene. This doesn't constitute assurance to the plainti...
